The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 406, 420, 504 of the Indian Penal Code. The prosecution case is that the petitioner took some articles from the Flour Mill of the informant worth Rs. 2,02,230/-. Part payment was made to the informant. Subsequently, further articles were also supplied to the petitioner, thereby the petitioner misappropriated Rs. 2,56,000/-.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.23053 of 2016 (2) dt.23-05-2016 petitioner that there is no proof with regard to supply being made and for a contractual nature of dispute the present case has been lodged. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Complaint Case No. 1271 of 2015, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
