1. Heard learned counsel for the parties.

2. The petitioner in this application prays for bail apprehending his arrest in connection with C.A. Case no.464 of 2018 registered for the offence punishable under sections 420, 406, 467, 468, 471 and 34 of the Indian Penal Code.

3. As per the prosecution case, the complainant states that on the basis of forged documents, the accused Sona Singh having taken a total amount of Rs.1.73 lacs executed registered sale deed with respect to the land which did not belong to him in favour of the complainant. It is further stated that the petitioner was amongst the person who was a witness to the said registered sale deed.

4. Learned counsel for the petitioner submits that from the allegations in the complaint itself, it would transpire that the allegations arise out of a civil transaction ie with respect

Patna High Court CR. MISC. No.54113 of 2025(2) dt.18-08-2025 2/2 to registration of sale deed. There is an inordinate delay of 3-4 years in lodging of the complaint. The petitioner is alleged only of being a witness to the said registered sale deed. He has no criminal antecedent and undertakes to cooperate in the case.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the complaint, the allegations against the petitioner being that of having witnessed the execution of the registered sale deed executed by Sona Singh in favour of the complainant together with the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with C.A. Case no.464 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge IX, Purnea.
