This application seeks restoration of MJC No. 4678 of 2012 which was dismissed for non prosecution on 14.05.2013. More than one year thereafter the present application has been filed.

The restoration application arises out of CWJC No. 4520 of 1990 wherein an interlocutory application was filed for substitution of the deceased respondent no.5 which stood dismissed for non prosecution.

On perusal of the pleadings made in the application and after hearing the counsel for the petitioners, this Court is not satisfied that a case for restoration of another restoration is made out. The application is dismissed.

Dismissal of this application shall, however, not
