JUSTICE ARUN KUMAR ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Gaighat P.S. Case No.127 of 2013 registered under Sections 304(B) and 34 of the Indian Penal Code.

Allegation in brief is that after marriage solemnized in the year 2013 petitioner/husband of the deceased used to make demand of motorcycle and torture his wife so she died un-natural death and it is alleged that she was killed by poisoning. Learned counsel appearing on behalf of the petitioner submits that there is no evidence with regard to making demand of dowry and F.S.L. report still has not been submitted in this case and charge already framed in this case against the petitioner. Case No.127 of 2013 pending in the court of Sub Judge XVI-CumA.C.J.M., Muzaffarpur is rejected. The trial court is directed to expedite the trial and conclude it preferably within a year, if the same is not concluded within the said period due to the latches of the prosecution, then the petitioner may renew his prayer for bail.
