JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 328, 201,34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons administered poison to the daughter of informant as a result of which she died.

Petitioner is husband of the deceased. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The marriage was solemnized 20 years ago but the deceased never complained about the torture at the hands of this petitioner. The deceased was seriously ill and information was given to the informant about her illness but during the course of treatment

Patna High Court CR. MISC. No.66045 of 2021(3) dt.18-04-2022 2/2 she died. During the post mortem examination the doctor did not find any external injury on the body of deceased and cause of death could not be ascertained. Petitioner claims clean antecedent and is in custody since 27.06.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Danapur, Patna in connection with Dulhin Bazar PS case No.290/2018.
