JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Bihta P.S. Case No. 844 of 2015 registered under Sections 341, 323, 354 and 504/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that that there is case and counter case and in fact the petitioner's mother Savitri Devi had lodged Bihta P.S.Case No. 845 of 2015 on 10th October, 2015 at 1.45 a.m. for the offences punishable under Sections 341, 323, 447, 354 and 504/34 of the Indian Penal Code against the son and family members of the informant Babita Devi.

Be that as it may, regard being had to the facts and

No.21174 of 2016 (2) dt.24-05-2016 2/2 circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners, namely, Arun Kumar @ Arun Kumar Yadav and Sahaja Kumar are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna in connection with Bihta P.S. Case No. 844 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
