Petitioner is seeking regular bail in connection with Special P.S. Case No. 52 of 2017 arising out of Patliputra P.S. Case No. 121 of 2017, registered for the offence alleged under Sections 3,4,5,6 and 7 of the Immoral Traffic Act, Section 20 and 22 of the Narcotics Drugs and Psychotropic act and Section 467, 468, 420, 294 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the First Information Report has been lodged by the Inspector-cumS.H.O. of the Patliputra Police Station. It is alleged that during a raid conducted by the informant in Hotel-cum- Restaurant, R.D. Inn, it was found that the hotel management alongwith one Poonam Bhatia were running a flesh trade in connivance and in
Patna High Court Cr.Misc. No.32355 of 2017 (2) dt.20-07-2017 2/2 concert with the other hotel staff. Learned counsel further submits that the hotel owners have been identified as one Pramod Kumar and Subodh Kumar, who are said to be involved in this business alongwith one Poonam Bhatia who comes from the State of Rajsthan and was allegedly involved in the trafficking of girls. Learned counsel further submits that the other accused persons named in the First Information Report are the staff of the hotel, this petitioner is one of them and similarly situated persons, namely, Chandan Kumar and Shailendra Kumar have been granted regular bail by two Co-ordinate Benches of this Court in Cr. Misc. Case No. 29146 of 2017 and 28628 of 2017 respectively.
Considering the facts and circumstances of the case, particularly that the petitioner is not named as owner of the hotel and restaurant, let the petitioner, namely, Anil Kumar be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, Patna, in connection with Special P.S. Case No. 52 of 2017 arising out of Patliputra P.S. Case No. 121 of 2017, subject to the conditions U/s 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J.)
