JUSTICE AMARESH KUMAR LAL ORAL ORDER 26-06-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201, 120B/34 of the Indian Penal Code.

The allegation is that due to non-fulfillment of demand of dowry, Anita Devi, the daughter of the informant had been killed by the accused including the petitioner.

It is submitted that the petitioner is the husband of the deceased and he was leading conjugal life happily and out of their wedlock, three daughters and one son were born. The deceased was suffering from anemia after giving birth to the last baby. Her treatment was made in Govt. Hospital, Jamui and thereafter, she (deceased) was referred to P.M.C.H., but due to poverty, there was delay in the arrangement of the money and in the meantime,

Patna High Court Cr.Misc. No.10808 of 2015 (6) dt.26-06-2015 2/2 she died. During investigation, it has come to light that the petitioner was not torturing his wife (deceased). However, after investigation, charge sheet has already been submitted and the petitioner has been in custody since 22.12.2014 having no criminal antecedent.

Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, Judicial Magistrate, 1st class, Jamui in Chandradeep P.S. Case No.75/2014 in the following conditions :

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
