06-07-2022 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Sections 395, 397 of the Indian Penal Code.

As per the F.I.R., on 29.12.2020, six unknown miscreants overtook the truck loaded with 500 bags of sugar and assaulted the driver (informant) and thereafter, they snatched keys of the truck alongwith cash of Rs. 60,000/- from the informant and fled away with the alleged truck loaded with sugar.

Name of the petitioner has transpired during course of investigation on the basis of confessional statement of coaccused Sanjeet Kumar. Alleged loaded truck was recovered near Jitaura Chowk on the road side and unloaded bags of sugar was recovered from the godown of one Madan Prasad. So far as

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari in connection with Sugauli P.S. Case No. 662 of 2020 (G.R. Case No. 9693 of 2020), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
