The petitioner seeks bail in Daudnagar P.S. Case No. 151 of 2021, registered for the offence punishable under Sections 420, 419, 468, 467, 34 of the Indian Penal Code, section 4/5 of the Bihar lottery Prohibition Act and section 11 of the Bihar Bengal Gambling Act.

As per the prosecution case, on secret information raid was conducted and one Umesh Choudhary was apprehended from whose possession three copies containing code and number of lottery was recovered. Umesh Choudhary disclosed name of this petitioner as one of the persons who fled away after noticing the police party.

It is submitted on behalf of the petitioner that name of

Patna High Court CR. MISC. No.65478 of 2021(2) dt.24-02-2022 2/2 this petitioner has come in this case on the basis of confessional statement of Umesh Choudhary. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent and he is in custody since 07.09.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Aurangabad in connection with Daudnagar P.S. Case No. 151 of 2021.
