JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Keseriya P. S. Case No. 224 of 2015 registered under Sections 147, 148, 341, 323, 315, 379 and 504 of the Indian Penal Code. Regard being had to the direct and specific allegation as against the petitioner no. 1,namely, Jangi Sahani that he assaulted the daughter-in-law of the informant, namely, Sabita Devi, as a result of which her pregnancy was terminated, I am not inclined to grant him pre-arrest bail. Accordingly, the application so far
Patna High Court Cr.Misc. No.21658 of 2016 (2) dt.25-05-2016 2/2 petitioner no. 1 is concerned, is rejected.
So far as other co-petitioners no. 2 and 3, namely, Usha Devi and Most. Raj Kumari Devi @ Most Anita Kuar are concerned, since there is general and omnibus allegation against them, in the event of arrest or surrender before the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in Keseriya P. S. Case No. 224 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
