The petitioner seeks bail in a case registered for the offences punishable under Section 366(a)/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.06.2021, charge-sheet has been submitted in this case and has antecedent of one case. The learned counsel for the petitioner further submits that the informant alleges that her minor daughter aged about 14 years is missing. Thus, alleges on suspicion that the petitioner took her away by enticing her.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The victim is a

No.65602 of 2021(2) dt.11-04-2022 2/2 major as would be evident from Annexure-2, which is the statement of the victim recorded under Section 164 of the Cr.P.C. wherein she has disclosed her age to be 18 years. It is further submitted that the victim has also not supported the prosecution case in her statement under Section 164 of the Cr.P.C.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and the victim has not supported the prosecution case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kadamkuan P. S. Case No.273 of 2021.

The application stands allowed.
