Petitioner seeks regular bail in connection with Goh P.S. Case No. 178 of 2022 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. As per the prosecution, the informant Bindeshwari Paswan alleged that one beheaded dead body of a female was recovered from the alleged place.
The main submissions advanced by learned counsel for petitioner are that against the petitioner there is no any material or evidence to connect him to the alleged occurrence and she is a lady and has been languishing in jail since 23.06.2022 and there is no eyewitness of the alleged occurrence and she is not named in the FIR.
Learned APP for the State has opposed the bail prayer.
Patna High Court CR. MISC. No.55438 of 2022(7) dt.13-03-2023 2/2 Heard both the sides and perused the FIR and the case diary in this case. The instant matter relates to brutal murder in which the victim's head was cut off by the accused persons and during investigation the petitioner's son confessed to the crime and on the basis of his disclosure statement the head and clothes of the deceased and other incriminating materials were recovered and the said co-accused also accepted the role of this petitioner in the alleged crime. Considering the seriousness of the occurrence, in my opinion, it is not a fit case for bail to the petitioner. Accordingly, her prayer for bail stands rejected. (Shailendra Singh, J) Shahnawaz/- U T
