The petitioner seeks pre-arrest bail in connection with Doriganj P.S. Case No. 140 of 2018 registered under Sections 188, 353, 307, 504 and 506 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that from the perusal of the first information report itself, it would appear that it was the driver and not the owner who was driving the vehicle in question. The contention is that neither the informant nor anyone else sustained any injury nor

Patna High Court Cr.Misc. No.43000 of 2018 (2) dt.20-07-2018 the rifle or cartridge was snatched from them. The first information report has been instituted only because the driver failed to oblige the informant who had demanded illegal gratification from the driver.

Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Considering the nature of allegation and submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner, who is said to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Saran at Chapra in connection with Doriganj P.S. Case No. 140 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
