JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 Petitioner is languishing in custody since 24.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 302, 307, 323, 341, 447, 448 of the I.P.C and Section 27 of the Arms Act.

It is alleged that ten accused persons including the petitioner entered into the house of the informant variously armed whereupon co-accused Pana Yadav, Tempoo Yadav and Pappu Yadav entered into the room of the son of the informant Sito Yadav and made indiscriminate firing causing injury to the son of the informant Sito Yadav, daughter-in-law Mina Devi and grand-son Kaila Yadav. Subsequently son of the informant Sito Yadav succumbed to the injuries. It is submitted by learned counsel for the petitioner that specific accusation of firing is against Pana Yadav, Tempoo Yadav and Pappu Yadav. Moreover the

Patna High Court Cr.Misc. No.13194 of 2015 (2) dt.07-04-2015 2/2 investigation has already concluded.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Basnahi P.S. Case No. 89 of 2013.
