The petitioners seek bail in a case registered under Sections 147, 148, 149, 323, 325, 337, 338, 307 and 302 of the Indian Penal Code.

Allegation against the accused persons including the petitioners is that they came armed with lathi, danda and bricks and started assaulting the informant's side, in which father of the informant sustained injuries and succumbed. It has been submitted on behalf of the petitioners that the petitioners are in custody since 24.5.2017 and have got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged

Patna High Court Cr.Misc. No.42302 of 2017(2) dt.19-09-2017 2/2 against the petitioner. No specific injury has been attributed against the petitioners. General and omnibus allegation has been made. Other co-accused have been granted bail vide Cr.Misc.No.27088 of 2017 and Cr.Misc.No.36934 of 2017. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Barharia P.S. case No.79 of 2017.
