This Civil Misc. application has been filed against the order dated 18.05.2022 passed by learned Principal Judge, Family Court, Lakhisarai in Maintenance Case No. 17 of 2020 initiated under Section 125 Cr.P.C. whereby and whereunder the petitioner has been directed to pay Rs.14,000/- per month as interim maintenance to the Opposite party till passing of final order.

Learned counsel for the petitioner on instruction of his clients submits that he is ready to make payment of Rs.10,000/- per month as interim maintenance to respondent-wife from the date of order instead of Rs.14,000/- per month, as passed in the impugned order dated 15.05.2022 and he has also prayed to dispose of this case accordingly. Learned counsel for the petitioner further submits that entire arrears amount will be paid within six months in equal monthly installments.

Patna High Court C.Misc. No.703 of 2022(5) dt.28-02-2023 2/2 Learned counsel for the respondent submits that respondent-wife is also agreed for the said proposal of the learned counsel for the petitioner and prayed to dispose of this case accordingly.

In view of the submissions made by learned counsel for the petitioner as also accepted by learned counsel for the respondent, the impugned order dated 18.05.2022 is modified on consent to the extent that instead of interim maintenance of Rs. 14,000/- per month in the impugned order, the same will be Rs.10,000/- per month to be paid by the petitioner to respondent-wife and the entire arrear amount shall be paid by the petitioner within six months in equal monthly installments. Accordingly, this case is disposed of with the aforesaid modification in the impugned order dated 18.05.2022. The learned trial Court is directed to dispose of the maintenance case expeditiously as far as possible preferably within six months.

Both the parties are directed to cooperate in early disposal of the said application.
