JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-08-2018 The petitioner is the mother of Harsh Raj who has passed 10th Examination held by the Central Board of Secondary Education (C.B.S.E.) in 2017. The name of mother of the said Harsh Raj has been entered in the certificate issued by the C.B.S.E. as 'Bably Gupta'. The petitioner, who claims to be the mother of said Harsh Raj, alleges that her name is 'Bably Kumar' and not 'Bably Gupta' and out of inadvertence 'Bably Gupta' was mentioned as mother's name at the time of admission of Harsh Raj in the School, which mistake continued even at the time of submission of examination form for the 10th Examination. She had applied for correction of her name, which
Patna High Court CWJC No.14352 of 2018(2) dt.29-08-2018 2/2 has been turned down by the impugned order dated 26.03.2018. It transpires from the impugned order that the C.B.S.E. turned down the petitioner's request for correction of mother's name of the said Harsh Raj, on the ground that what has been entered in the certificate is correct on the basis of School record. This is not being disputed.
The learned counsel for the petitioner, based on pleadings in the writ application, has submitted, however, that the name of the petitioner is 'Bably Kumari' and not 'Bably Gupta'.
I do not find any illegality in the decision of the Board which is based on the records of the School.
If it is the claim of the petitioner that 'Bably Kumari and 'Bably Gupta' are the names of one and same person, the petitioner shall have a liberty to take appropriate steps. This writ application stands disposed of.
