ANJANA MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Karakat P.S. Case No. 7 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 384, 324, 325, 307 and 353/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.23616 of 2016 (4) dt.31-08-2016 2/2 Learned counsel for the petitioners submits that the present petitioners are not named in the FIR, however, subsequently on account of some mischief of co-villagers, the names of the present petitioners have surfaced in the present case stating that they were some of the said unknown persons, referred to in the FIR.
Having considered the facts and circumstances and that there appears to be a bona fide land dispute between the Dafadar Kulbansh Singh and the petitioners, who were named in the FIR and also because there is a counter version in the case, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Karakat P.S. Case No. 7 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
