====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 09-02-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends his arrest in connection with Buxar Muffasil P.S. Case No. 214 of 2025 instituted for the offences Sections 303(2)/317(2)/3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per prosecution case, the accusation against the accused persons including the petitioner is of stealing three aluminum coils worth Rs. 3,12,196/- from S.J.V.N. Power Plant out of which they sold a coil to the petitioner Ajay Thathera.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. The petitioner is not doing any type of business nor he has any

Patna High Court CR. MISC. No.62114 of 2025(5) dt.09-02-2026 2/2 shop for purchase and sale of coil. The name of the petitioner transpires on the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner. The petitioner has no concern with the alleged occurrence. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged is serious in nature. The petitioner has purchased the alleged wire.

6. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Buxar Muffasil P.S. Case No. 214 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
