JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and 11 (i)(a) (d) of The Prevention of Cruelty to Animals Act, 1960.

Prosecution case is that the cattle were seized while being transported after tying their legs.

It is submitted by learned counsel for the petitioner that the cattle were released in favour of the respective owners. The petitioner is owner of the pick-up van. The petitioner was not aware about the cattle being transported by the driver. Since the cattle have been released by the learned Court below to the respective owner, no case is made out against the petitioner. A statement has been made in paragraph 3 of the

Patna High Court Cr.Misc. No.24343 of 2016 (2) dt.31-05-2016 2/2 petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Kaimur (Bhabua) in connection with Ramgarh P.S. Case No.285/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
