JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

The prosecution case is that on 15.01.2016 at 10 AM when the informant Md. Hamja reached to his office and opened the gate then he found that lock of the room was broken and computer, printer, battery, stabilizer and inverter were missing when suspicion was raised against the petitioner. It is submitted by learned counsel for the petitioner that the petitioner was actually working on casual basis in the office of the informant and made complaint against the informant to the higher officials about corruption and other irregularities due to which departmental proceeding was initiated against the

Patna High Court Cr.Misc. No.24150 of 2016 (2) dt.31-05-2016 2/2 informant, hence the informant maliciously raised suspicion against the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Khagaria P.S. Case No. 28 of 2016 pending in the court of learned CJM, Khagaria. Accordingly, the application is disposed of.
