2. In this case, the petitioner is seeking regular bail in connection with Sidhwaliya P.S. Case No. 186 of 2024, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.

3. As per allegation, on a secret information, the informant along with other police party reached the place of occurrence and apprehended two accused persons, sitting on a Hyundai Car. The apprehended persons disclosed their names as Sanjay Malhotra and Ravi (the petitioner). On search, 265.5 liters of foreign liquor was recovered from the dicky and seat of the alleged vehicle.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.59142 of 2024(2) dt.27-08-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. Nothing has been recovered from his conscious possession. He is under custody since 01.07.2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIII-cum Special Judge ExciseI, Gopalganj in connection with Sidhwaliya P.S. Case No. 186 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) Before release, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case of similar nature except the present one, his bail bond shall not be accepted.
