The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No. 662 of 2018, registered under Sections 147, 148, 149, 295(a), 153(a) and 302 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that 5-6 persons named in the F.I.R. along with 10-15 unknown entered in the procession of Muharram and started to cause assault. At that time, Mukesh Paswan and Raju Mahto started to open fire, in which, Md. Sahnawaj, son of the informant sustained injury at his chest and one Md. Arif Khan also sustained injury at his stomach. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.51982 of 2019(2) dt.21-08-2019 2/2 petitioner is not named in the F.I.R. but in course of investigation, one Md. Baksi disclosed the name of Rakesh Das, Anand Kumar, Aman Sah and Vikash Sah (petitioner) without any overt act, in fact, Md. Baksi used to run the chicken shop adjacent to the cloth shop of the petitioner and due to grudge enmity, he disclosed the name of petitioner and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No. 662 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
