Petitioners apprehend their arrest in Suryapura P.S. case no. 24 of 2018 instituted for the offence under Section(s) 147,149, 323, 307,504 506 and 379 of the Indian Penal Code. Learned counsel for the petitioners has submitted that prosecution party had earlier brutally assaulted petitioner no.1 and others for which Suryapura P.S. case no. 23/18 was lodged . The instant case is counter blast of the aforesaid case. In the instant case, there is general and omnibus allegation against petitioner nos.1, 2, 3, 4 and 5. It is alleged

Patna High Court Cr.Misc. No.44026 of 2018(2) dt.25-07-2018 2/3 against petitioner no.6 that he assaulted the informant with lathi on his head. In the instant case injury is sustained by three persons. Referring to the injury report of one of the injured which has been annexed as Annexure 3, it is pointed out that opinion with respect to injuries have been kept reserved. It has further been submitted that learned sessions Judge Sasaram has mentioned in the impugned order that doctor has found simple injury on the person of informant and one another injured. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Suryapura P.S. case no.

24 of 2018, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Bikramganj (Rohtas), subject to the conditions as laid down under Section 438(2) Cr. P.C.

Patna High Court Cr.Misc. No.44026 of 2018(2) dt.25-07-2018 3/3 reason will automatically cancel bail bond of the petitioners and

(3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
