The petitioner apprehends his arrest in Complaint Case No.83 of 2018 registered under Sections 406 and 420 of the Indian Penal Code.

The complainant alleged that the petitioner purchased paddy and Rs.1,55,345/- remained due with the petitioner but the petitioner did not pay the amount. The complainant further alleged that the petitioner also purchased paddy from Rajbansh Singh, Purnwasi Pathak, Jitendra Singh, Munna Sah and Sarju Pathak but the petitioner did not make payment to them. The learned counsel for the petitioner submits that dispute arose due to rendition of accounts. The petitioner of

Patna High Court CR. MISC. No.53600 of 2019(2) dt.27-08-2019 2/2 course purchased paddy but he paid the price of the paddy to the complainant and others and dispute arose on account of nonpayment. According to the petitioner, petitioner has already paid the entire amount.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-VI, Kaimur at Bhabua in connection with Complaint Case No.83 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
