The petitioner who is in custody since 14.02.2019 in the instant case has filed this application for grant of bail in connection with Danapur P.S. Case No. 128 of 2019 (District Patna) registered for the offence punishable under sections 341,323,332,353 and 224 of the Indian Penal Code. As per the allegation in the FIR, while the petitioner was returning to jail custody from the Court, he managed to escape from the clutches of the police.

It is submitted by learned counsel for the petitioner that the petitioner is a person of mild unsound mind and he belongs to a very poor family and that he is in custody since 14.02.2019.

The application for bail has been opposed by learned APP

Patna High Court CR. MISC. No.51139 of 2019(5) dt.25-10-2019 2/2 for the State.

Having heard learned counsel for the parties and taking into consideration that the petitioner is in custody since 14.02.2019, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st Danapur, Patna in connection with Danapur P.S. Case No. 128 of 2019 (District Patna).
