JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(1-B)A/26 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected by this court with direction to the trial court to expedite the trial of the petitioner and conclude the same as early as possible but the impugned order dated 17-05-2016 goes to show that uptill now, charge could not be framed against the petitioner who is languishing in jail custody since 04-10-2015. It would appear from the above-said fact that the trial court has not taken the direction of this court seriously. However, the trial court is directed to conclude the trial of the petitioner

Patna High Court Cr.Misc. No.25336 of 2016 (2) dt.17-08-2016 2/2 within 4 months from the date of receipt/production of copy of this order failing which, the matter shall be viewed seriously and the petitioner shall be at liberty to renew his prayer for bail. With the aforesaid direction/observation, prayer for bail of the petitioner in connection with Shastri Nagar P.S. Case No. 538 of 2015 pending in the court of Smt.
