This application is for grant of regular bail in connection with Bettiah Muffasil P.S.Case No.238 of 2016 for the offences punishable under Sections 395/397 of the Indian Penal Code.

The petitioner is not named in the F.I.R. and on the basis of confession of the co-accused, his name transpired in this case. From perusal of the record, it appears that he is accused in nine other cases also and he is accused in five other similar type of cases also.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner and the petitioner is in custody for about six months.

Patna High Court Cr.Misc. No.33148 of 2017 (2) dt.21-07-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of allegation as well as criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. At the same time, the S.P., West Champaran at Bettiah has to ensure presence of the witnesses in this case so that the trial may be concluded within the time as specified. With the aforesaid observation, this application is dismissed.
