JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This is an application for grant of anticipatory bail in connection with Kalyanpur P. S. Case No. 129 of 2019, disclosing offences under Sections 272, 273, 34 of IPC and Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

There is recovery of more than 700 liters of country made liquor from the hut of the petitioner.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. He has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that recovery is from the hut of the petitioner.

Having heard both sides, in view of the allegation and

Patna High Court CR. MISC. No.51790 of 2019(3) dt.04-11-2019 2/2 the quantity of the liquor recovered from the hut of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail before the learned court below.
