====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Jokihat P.S. Case No. 133 of 2017, registered for the offence punishable under Sections 461 and 379/34 of the I.P.C. It is the allegation of the informant that some unknown accused persons have stolen pumping set as well as Dynamo, Solar Plate and a mobile phone from the shop cum godown of the informant.

Learned counsel for the petitioner submits that the petitioner has a clean antecedent and no recovery has been made from the possession of the petitioner. It is further submitted that the petitioner has been falsely implicated in this case and further also submits that similarly situated co-accused person has already been granted bail vide order dated 13.07.2017 passed in Cr. Misc.

Patna High Court Cr.Misc. No.33684 of 2017 (2) dt.20-07-2017 2/2 Case No. 31204 of 2017 by a Bench of this Court. It is further submitted that the petitioner is in custody since 25.04.2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Araria, in connection with Jokihat P.S. Case No. 133 of 2017 (Mohit Kumar Shah, J) khushbu/- U T
