JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-461, 379, 427, 399, 402, 414 of the Indian Penal Code and Sections-25(1-b)a, 26, 35 of the Arms Act. Petitioner is not named in the first information report nor anything has been recovered from his conscious possession. From perusal of the impugned order, I find that three co-accused namely, MantuYadav, Suday Kumar and Arun Kumar were arrested in connection with Khudaganj P.S. Case No. 11 of 2016 and stolen vehicle as well as mobile were recovered from their possession. The aforesaid apprehended co-accused disclosed

Patna High Court Cr.Misc. No.26133 of 2016 (2) dt.05-07-2016 2/2 the involvement of the petitioner in the present case as well as in some other cases. It appears that except the aforesaid material, there is nothing against the petitioner.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chhabilapur P.S. Case No. 08 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Bihar Sharif, Nalanda.
