JUSTICE RAKESH KUMAR ORAL ORDER 30-06-2016 Heard Sri Binay Kumar, learned counsel for the petitioner and Sri Jitendra Kumar Singh, learned A.P.P. The sole petitioner, apprehending his arrest in connection with Pakridayal P.S. Case No. 19 of 2016 registered for the offence under section 467, 468, 471, 469, 414 of the Indian Penal Code, has prayed for grant anticipatory bail. It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated. He submits that only on the basis of the statement of the co -accused the petitioner was named as accused in the present case. He further submits that even the co -accused has simply said that petitioner and one another had asked to purchase a stolen motorcycle. He submits that petitioner was not apprehended and falsely on the basis of confessional statement of the co- accused petitioner has

Patna High Court Cr.Misc. No.26493 of 2016 (2) dt.30-06-2016 2/2 been made accused. He further submits that petitioner is having clean antecedent. This fact has been stated in paragraph no. 3 of the petition.

After hearing and considering facts and circumstances of the case, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Ajay Rai @ Ajay Kumar Bhagat @ Ajay Kumar be enlarged on bail on furnishing bail bond of Rs.10000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 6th Motihari in connection with Pakridayal P.S. Case No. 19 of 2016 subject to the conditions as contemplated under section 438 (2) of the Code of Criminal Procedure.
