JUSTICE ARVIND SRIVASTAVA ORAL ORDER 31-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Marhauraha P.S. Case No. 79 of 2017 registered for the offence punishable under sections 420, 493, 496, 120B of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been implicated in this case due to enmity. Petitioner even requested the informant and his father to for DNA test, but they refused. Learned counsel has prodcued copy of the compromise petition filed in the Court below to show that parties have amicably settled their difference and there remains no dispute between them and the present case was lodged at the instance of their enemies. No.39572 of 2017(4) dt.31-10-2017 2/2 submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Singh, Judicial Magistrate, 1st Class, Saran at Chapra in connection with Marhauraha P.S. Case No. 79 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
