The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 413, 414 of the Indian Penal Code.

Prosecution case relates to recovery of stolen motorcycle bearing Reg. No. BR28W-8893 and on demand petitioner could not produce any valid document in respect of ownership of vehicle.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner was standing and waiting for bus to going Kesariya in the meantime, he was arrested by the police and they took his signature on white paper to which they manufactured as seizure

Patna High Court CR. MISC. No.55741 of 2023(2) dt.31-08-2023 2/2 list. He has not been put on TIP. Petitioner has got no criminal antecedent and languishing in judicial custody since 20.6.2023.. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial magistrate VII, Gopalganj in connection with Mohammadpur P.S.
