JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Buxar (Industrial) P.S. Case No. 96 of 2014 for the offences instituted under Sections 147, 149, 323, 354, 379 and 504 of the Indian Penal Code.

As per prosecution case, it is alleged by the informant that all the named accused persons on the alleged time of occurrence were erecting fencing and they started abusing and assaulting and the petitioner also snatched Rs.10,000/- from the pocket of the informant which was kept for purchasing bricks. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has falsely been

Patna High Court Cr.Misc. No.27373 of 2016 (2) dt.12-07-2016 implicated in the present case. There is admitted land dispute between the parties. The other co-accused persons have been granted anticipatory bail by this Court vide Cr.Misc.No.39314 of 2014.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Buxar (Industrial) P.S. Case No. 96 of 2014 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
