====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 19-08-2025 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner has approached this Court for grant of following relief :- "1(i) For issuance of an appropriate writ/writs in the nature of writ of mandamus commanding the respondents to forthwith delivery possession of land settled vide Settlement Case No.55/1976-77/141/1977-78 and 56/1976-77/221/1977-78 respectively by the State of Bihar to the petitioners, which till date has not been done. (ii) For direction to the respondents directing them to give the possession of settled land to the petitioners.

(iii) For grant of any other relief/reliefs to which the petitioner may be entitled to in the facts and circumstances of the case."

3. In paragraph 15 of the writ application, the petitioner has stated as follows :- "15. That the petitioner has also filed a case before DCLR (respondent No.3) for delivery of possession of their settled land u/s 4 of the BLDR

Patna High Court CWJC No.12999 of 2025(2) dt.19-08-2025 2/2 Act vide Case No.2/ 25, but no action has been taken."

From the above statement made in paragraph 15 of the writ application, it is clear that for a land which the petitioners claims has been settled in his favour in 1977-78, a case has been field before the DCLR after 47 years which as per the petitioner is pending before the DCLR, Sasaram, Rohtas. At this point of time, learned counsel appearing for the petitioner prays for withdrawing the present writ application for pursuing his case which is pending before the DCLR, Sasaram, Rohtas.

5. As prayed for by learned counsel for the petitioner, the present writ application is dismissed as withdrawn.

6. All pending I.As., if any, shall be deemed to have been disposed of.
