JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-04-2024 The present writ petition has been filed seeking the following reliefs:- "1(A). For issuance of appropriate writ/order or direction commanding the respondents to make payment of full of Ex- gratia amount of Rs. 30,00,000/ (thirty lacs) to the petitioner as the wife of the petitioner Mala Devi died on 7.10.2020 in course of election duty in the Bihar General Assembly Election 2020 in the state of Bihar.

(B). For commanding the respondents to appoint the petitioner's son in Govt. Job as nobody in the petitioner's family is in govt. service after death of his wife who died on election duty."

At the outset, the learned counsel for the petitioner submits that admittedly the petitioner has been paid a sum of Rs. 15, 000,00/- by way of ex-gratia amount, however, his claim is for a sum of Rs. 30,000,00/-, which according to the Respondents is not permissible as per resolution No. 558 and 607 dated 6.6.2019 and 1.10.2020 respectively, issued by the Finance Department, Government of Bihar, Patna. Nonetheless, the Ld. Counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Respondent No. 4, i.e. the District Election Officer-cum-District Magistrate, Gopalganj, for redressal of his subsisting grievances. Liberty, so sought, is granted.
