The petitioner seeks bail in Malsalami P.S. Case No. 107 of 2017 registered under Sections 420, 354A, 504, 506, 509 and 120B of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
As per the prosecution case, the marriage of the informant was settled with the petitioner and Rs. 4,50,000/- in cash and other articles were furnished to him at Tilak. Thereafter, the petitioner started visiting her house and took her to his house and tried to outrage her modesty, but on protest, he scolded her. He refused to marry with the informant due to non-fulfillment of additional demand of Rs. 1,00,000/-.
Patna High Court Cr.Misc. No.33931 of 2017 (2) dt.20-07-2017 2/2 It is submitted by learned counsel for the petitioner that the allegation levelled against the petitioner is false and concocted. As a matter of fact, the mother of the petitioner has filed informatory petition against the informant and her parents much earlier to the case at hand. The petitioner has been languishing in custody since 09.06.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna in connection with Malsalami P.S. Case No. 107 of 2017.
