The petitioner is apprehending his arrest in connection with Lalganj P.S.Case no.165/19 dated 15.5.2019 registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 324, 395, 354(A), 325, 354(B), 353, 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. Prosecution story is that the petitioner and several other accused persons came variously armed and there is allegation against the co-accused that he assaulted the informant by Farsa and so far this petitioner is concerned, it is alleged that he assaulted by the BUT portion of the rifle. There are allegations against the other accused persons also of assault and snatching of Rs.06,000/- and 400 gram of gold apart from that it appears that the petitioner is accused in five other cases including a case
Patna High Court CR. MISC. No.51571 of 2019(2) dt.19-08-2019 2/2 under Section 307 of the IPC.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
With the aforesaid direction, this application is dismissed.
