The petitioner apprehends her arrest in connection with Rupouli P.S. Case No.53 of 2019 registered under Section 7 of the E.C. Act.
The accusation is that on receiving secret information about carrying the packets of food-grains of PDS shop loading on the tempo for selling the same in the black market, the informant being the Block Supply Officer Rupouli along with others reached at Gokhli Tola, then found a tempo loaded with 7 packets of rice. The driver of the tempo disclosed that the said packets were loaded from the PDS shop of the petitioner. Learned counsel for the petitioner submits that after
Patna High Court CR. MISC. No.50913 of 2019(2) dt.17-08-2019 2/2 seizing the packets of rice, which are said to be loaded on the tempo from the PDS shop of the petitioner, neither the stock of the PDS shop of the petitioner was verified nor any complaint was received from any consumer against the petitioner. The petitioner has falsely been implicated in this case. Moreover, after lodging of the present case, the license of the PDS shop of the petitioner has already been suspended.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnia, in connection with Rupouli P.S. Case No.53 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
