JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Petitioners are languishing in custody since 14.08.2014 in a case registered for the offences punishable under Sections 302/34 of the I.P.C.

It is alleged that co-accused Sanjay Yadav and Sandip Yadav informed about illness of the brother of the informant. The informant found his brother in unconscious position when the petitioners were also there along with the coaccused. Subsequently the victim was taken to the hospital but on the way the victim died when it was alleged that accused persons including the petitioners killed the brother of the informant.

It is submitted by learned counsel for the petitioners that informant is not the eye witness when petitioners are eighty years of age and investigation has already concluded.

No.10684 of 2015 (2) dt.19-03-2015 2/2 Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No. 171 of 2014.
