The petitioner seeks bail in Sultanganj P.S. Case No. 96/14 registered for the offence under Section 302 and other sections of the Indian Penal Code.

The petitioner is not named in the FIR and only suspicion is raised that the student living in room no. 2 to 5 might have killed the deceased Indradeep Kumar.

It is submitted that except suspicion there is no material against the petitioner. Even the call detail of the petitioner does not disclose that the petitioner went inside the room of the deceased. The police took confessional statement of the petitioner and except the confessional statement no material was collected to show that the petitioner committed murder of the deceased.

The key of the room of the petitioner was also recovered from the room of the deceased. Except this no material is collected to show in anyway the involvement of the petitioner. He is in jail since 23.10.2014. Considering the facts aforesaid, petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Rai, learned Judicial Magistrate, Patna City in connection with Sultanganj P.S. Case No. 96/14. (Prabhat Kumar Jha, J) Vinita/- U T
