JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 414 of the I.P.C. as well as Sections 25(1B)A, 35 of the Arms Act and Sections 16, 17, 18, 19, 20, 21 and 23 of U.A.P.A. Act.

Allegedly, the petitioner and co-accused Raj Kumar Sahni were arrested and on the basis of their confessional statement, the police rifle was recovered, which was kept beneath the land.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.02.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. One police

Patna High Court Cr.Misc. No.29371 of 2016 (3) dt.29-09-2016 rifle is said to have been recovered on the confession of the petitioner. The said confession made before the police is denied by the petitioner. The other co-accused has been granted bail vide Cr.Misc.No.31080 of 2016.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Minapur P.S. case No.274 of 2015.
