This is an application for bail in connection with Sessions Trial No. 781A of 2013, arising out of Kasim Bazar P.S. Case No. 20 of 2007 registered for the offences punishable under Sections 307/34, 302 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is under Sections 302/34 IPC and it further appears that Sessions Trial is going on. Submission of learned counsel for the petitioner is that seven witnesses have been examined in this case and during last one year only one witness has been examined and he is in custody for two years and I.O. has to be examined in this case. Heard learned APP also.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.42089 of 2017 (2) dt.12-09-2017 2/2 circumstances, learned Additional Sessions Judge-II, Munger is directed expedite the trial and try to conclude it within a reasonable period. At the same time, Superintendent of Police, Munger is directed to ensure the presence of I.O. to be examined in court and submit a report to this Court about examination of I.O. of the case.
