2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in a case instituted for the offence punishable under Sections 461, 379 of the Indian Penal Code.
3. As per allegation in the F.I.R., ten bags rice and one water pump motor was stolen by unknown miscreant from the Middle School, Russi, Saran District.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in F.I.R. nor he has been put on T.I.P. Nothing incriminating has been recovered from his possession. The name of petitioner sprang up in this case on confessional statement of coaccused Ratnesh Singh from whose house the stolen items were recovered.
5. Learned A.P.P. for the State has vehemently opposed the prayer of bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Jalalpur P.S. Case no. 53 of 2024, they will be enlarged on bail on

No.61817 of 2024(3) dt.20-11-2024 3/3 furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIII, Saran, Chapra, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
