JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-05-2015 Heard the learned counsel for the petitioner as well as the learned A.P.P.

The petitioner wants to renew his prayer for bail which has already been rejected by order dated 15.07.2014 vide Cr. Misc. No. 17753 of 2014 on the ground that the petitioner is suffering in custody since 10.06.2013 and there is no likelihood of early conclusion of trial. Charge-sheet has already been submitted against the petitioner and the case has already been committed to the court of Sessions. Co-accused Devendra Yadav @ Dawandra Yadav, father of the petitioner, has already been granted bail by another Bench of this Court by order dated 20.03.2014 vide Cr. Misc. No. 36608 of 2013. Further other co-accused, namely, Awinash Kumar Das and Vijoy Kumar Das have already been

The learned A.P.P. opposes prayer for bail.

Considering that the petitioner is one of the assailant allegedly he had shot in the stomach of brother of the informant and further the petitioner also assaulted with bamboo till the death and as such this Court is not inclined to release the petitioner on bail and accordingly again prayer for bail of the petitioner is hereby rejected in connection with Bibhutipur P.S. Case No. 59 of 2013 pending in the court of A.C.J.M. Rosera, DistrictSamastipur. However, the trial court is directed to expedite the trial and conclude the same as early as possible preferably within a period of six months.
