JUSTICE SANJAY PRIYA ORAL ORDER 04-09-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No.95 of 2017 instituted for the offence under Section(s)363(A), 370 of the Indian Penal Code and 23/26 Juvenile Justice Act.

It has been submitted that mere suspicion has been raised against the petitioner. In the written report, allegation has been made that the petitioner was seen going along with 7-8 children one mile outside the village. It is alleged that petitioner had taken the children either for sale or begging. It has been submitted that all the eight children were found near Bislakhiya Pool where they had gone to take bath in the river. As such, mere suspicion has been

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sahara in connection with Bakhtiyarpur P.S. Case No.95 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
