20.02.2015 Heard learned counsel for the parties.

Submission of the counsel for the petitioner is that the present case has been lodged against him as retaliation to an earlier case lodged by the petitioner's wife against the informant and his family.

Other argument is that looking at the nature of the injury, section 307 IPC also is not made out, as such. In view of the above facts and circumstances, anticipatory bail application of the petitioner is allowed. Let the petitioner, above-named, in the event of his arrest or surrender within a period of four weeks from today, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P. S.

Patna High Court Cr.Misc. No.36051 of 2014 (2) dt.20-02-2015 2/2 Case No. 87 of 2014, which shall be abide by the terms and conditions mentioned in sub-section (2) of section 438 of the Code of Criminal Procedure.
