The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 431, 307, 353 of the Indian Penal Code, Section 27 of the Arms Act, Section 17 of C.L.A. Act and Sections 10, 11, 13(1)A, 13(1)B of U.A.P. Act. It is alleged that there was cross-firing between the police and the extremists in the night of 16.06.2011 in front of Kothi P.S., in which petitioner's name was mentioned without any legal evidence.
Earlier the bail application of the petitioner was rejected vide Annexure-1/A to the present application and the same was rejected with an observation "at this stage". This is the second attempt for grant of bail on
Patna High Court Cr.Misc. No.19183 of 2017 (3) dt.12-07-2017 2/2 behalf of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.10.2015 i.e. for the last 22 months. The charge sheet has been submitted in the present case. Altogether 22 persons are named in the F.I.R. No specific allegation has been made against the petitioner. The other coaccused has been granted bail by this court vide Cr. Misc. No. 4590 of 2017.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati (Gaya) in connection with Kothi P.S. Case No. 20 of 2011, Tr. No. 4386 of 2017.
